10 SEER repair

I had a Realtor tell me today a client backed out of a sale because the HVAC guy told them that under AZ law, they cannot REPAIR a 10 seer unit! Does anybody know if this is true?

I understand that you cannot replace a 10 SEER with a 10 SEER, but repair?

Also, is there any way to determine the SEER rating? I was looking at Carrier website the other day and the model I looked up came in 10 or 12 SEER, seemed to be the same model #.
