Yesterday, my inspection had a masonry fireplace chimney that was reworked so a gas log insert was installed and it had a new metal liner. The masonry chimney was built too short for a fireplace, but now that it's re-lined, does the chimney rule apply or does the B vent rule apply? Click to Enlarge 61.36 KB

I don't think the chimney rule would apply unless the owners decide to go back to wood-burning. What if they tore the bricks off down to the roofline and went with a metal stack? They will need to fix that flashing, so that would be a better option, IMO.

If it is in fact, lined with a B-vent, and has a listed B-vent termination, it no longer has any potential for burning solid fuel.
